V-Line Battery Power Delivery Warranty
Five Year Agreement

WARRANTY: V-Line batteries manufactured by C&D TECHNOLOGIES, INC. are warranted against defective materials and workmanship for a period of 60 months from date of shipment or 1500 cycles, whichever comes first. As the sole and exclusive remedy in discharge of the Warranty, C&D TECHNOLOGIES, INC. agrees that if a battery fails to provide a minimum of 80 percent of its published rated capacity in ampere-hours at the six-hour rate, when tested under direction of the Technical Service Dept. C&D TECHNOLOGIES, INC. supervision and in accordance with BCI Specification BCI-1-2, or its latest revision, prior to 60 months from date of shipment or 1500 cycles, C&D TECHNOLOGIES, INC., at its option, will either (a) repair battery to deliver in excess of eighty percent of its published rated capacity at its expense for both labor and parts, exclusive of freight, as directed by its technical service department, or (b) furnish a suitable replacement battery, having a rated capacity equal or greater than the published rated capacity of the battery returned in exchange for the original battery. The repaired or replacement battery shall complete the remaining unused portion of the warranty for the original battery. After the replacement battery completes the warranty term of the original battery, C&D TECHNOLOGIES, INC. reserves the right to offer a pro-rata adjusted sale to the customer to purchase it, or return it to C&D TECHNOLOGIES, INC. freight prepaid and allowed for disposition. Further, User must give C&D TECHNOLOGIES, INC. prompt notice of alleged defects and return alleged defective cells or battery to C&D TECHNOLOGIES, INC., F.O.B. destination, return freight prepaid and allowed, for evaluation.

Conditions for Warranty Coverage
  1. User and C&D TECHNOLOGIES, INC. shall mutually agree that each battery is of the proper size, design and capacity for the duty it is to perform and will not be required to perform at any time during its service life in excess of its agreed value.
  2. User shall install and maintain each battery in accordance with the C&D TECHNOLOGIES, INC. Installation and Operation Manual, 7-710, and Instruction and Maintenance Guide, RS-124, shipped with every battery, as may be amended from time to time.
  3. Batteries shall be limited to one cycle of discharge and recharge (cycle) per 24-hour day and no more than 80 percent of the rated six-hour capacity as determined by a BDI (battery discharge indicator) and nom more than 300 cycles each calendar year.
  4. Each battery shall be charged on a properly sized, automatic, logic controlled, regulated charger as set forth in BCI Specification BCI-1-4 or its latest revision. Recharge must be accomplished during the same 24-hour period described in item 3 above.
  5. C&D TECHNOLOGIES, INC. representatives shall be given access to equipment furnished hereunder for purposes of inspection at reasonable hours and intervals.
  6. Records on the operating and physical conditions of the battery shall be maintained for all years of service life. Records must verify the proper operating conditions as described and recommended in the C&D TECHNOLOGIES, INC. Installation and Operation Manual, 7-710, and Installation and Maintenance Guide, RS-124, shipped with every battery, as may be amended from time to time.
  7. The electrolyte temperature of batteries shall not exceed 115F (46.1C) or drop below 45F (7.2C).
  8. C&D TECHNOLOGIES, INC. shall not be responsible for any costs to remove or install batteries.
  9. C&D TECHNOLOGIES, INC. shall not be responsible for consequential, incidental, indirect, special, and punitive damages or for work done or expenses incurred in connection with repair.
  1. User shall not add truck accessories, change duty cycle or employ voltage taps unless agreed to in writing by the C&D TECHNOLOGIES, INC. technical service department.
  2. User shall not continue use of batteries after discovery of defect.
  3. This warranty is void if the battery becomes unserviceable due to fire, wreckage, freezing, neglect, abuse, acts of God, use of battery additives, or if the battery has been serviced by anyone other than C&D TECHNOLOGIES, INC. or its representatives.
Five- and seven-plate batteries are warranted for 12 months or 300 cycles, covering parts and labor. A pro rata warranty is extended for an additional 24 months or 600 cycles for a total of 36 months or 900 cycles, subject to all conditions stated above.

The foregoing is the sole and exclusive remedy in discharge of the warranty, C&D TECHNOLOGIES, INC. liability for damages, whether based upon alleged negligence, breach of warranty, breach of contract, or otherwise, shall in no event exceed the purchase price of the specific item with respect to which such damages are claimed.

Limitation: This Limited Warranty Agreement extends only to original purchaser (User) and is non-transferable. Except as authorized in writing, this warranty does not cover any equipment that has been altered by any other party other than C&D TECHNOLOGIES, INC. or its agents. User shall indemnify and save C&D TECHNOLOGIES, INC. harmless from any claims and liabilities arising out of the use, maintenance, transportation, or installation of any equipment warranted hereunder. THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. C&D TECHNOLOGIES, INC. MAKES NO WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL C&D TECHNOLOGIES, INC. BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUANTIAL DAMAGES.
